3 Acceptance of the Terms

By creating an account, placing an order, making a booking, subscribing to a 3buddy service, or otherwise using the Platform, you confirm that:

  • You have read these Terms.
  • You understand these Terms.
  • You agree to comply with these Terms.
  • You have legal capacity to enter into the relevant agreement.
  • Information you provide is accurate and up to date.

If you use 3buddy on behalf of a company or Restaurant, you confirm that you are authorised to accept these Terms on that organisation’s behalf.

4 Separate agreements

Different activities through 3buddy may create separate contractual relationships.

For example:

Restaurant software subscription

A Restaurant may enter into a separate agreement with Rexett AB for access to 3buddy’s SaaS services.

Restaurant order

When a Customer places an order with a Restaurant, the purchase of food or other products is generally an agreement between the Customer and the Restaurant.

Restaurant booking

A table reservation is generally an arrangement between the Customer and the Restaurant.

Payment

Online card payments are collected by Rexett AB through Stripe and transferred to the Restaurant as described in section 11. Stripe and other payment providers may also have their own terms.

The specific agreement, price, seller and applicable conditions presented during a transaction will apply to that transaction.

5 3buddy as a technology platform

Unless explicitly stated otherwise, 3buddy provides technology and software infrastructure and does not itself operate the individual Restaurants listed on the Platform.

Restaurants are responsible for:

  • Their menus
  • Food and beverage products
  • Prices
  • Availability
  • Allergens and ingredient information
  • Opening hours
  • Restaurant policies
  • Order preparation
  • Pickup
  • Restaurant-managed delivery
  • Table reservations
  • Refunds relating to their products or services
  • Compliance with applicable food, tax, consumer and business regulations

Where a Customer purchases food or services from a Restaurant, the Restaurant is generally responsible for fulfilling that transaction.

6 Restaurant accounts

Restaurants may create accounts to access 3buddy’s business services.

Restaurant Users must provide accurate information and keep account information up to date.

Restaurants are responsible for:

  • Maintaining the confidentiality of login credentials
  • Controlling access to their account
  • Creating and managing authorised users
  • Ensuring that employees and other users comply with these Terms
  • Protecting devices used to access the account
  • Immediately notifying 3buddy of suspected unauthorised access

A Restaurant must not share administrator credentials with unauthorised persons.

Restaurants are responsible for all activity performed through their account unless the activity resulted from unauthorised access that was reported to 3buddy without unreasonable delay.

7 Customer accounts

Some 3buddy features may require a Customer account.

Customers must provide accurate information and must not create accounts using another person’s identity without authorisation.

Customers are responsible for keeping their login information secure.

3buddy may require account verification where reasonably necessary for security, fraud prevention or service operation.

8 Online orders

Customers may use 3buddy to place online orders with participating Restaurants.

Before submitting an order, the Customer should review:

  • Restaurant
  • Items
  • Quantities
  • Options and extras
  • Price
  • Taxes where applicable
  • Pickup or delivery information
  • Estimated preparation or delivery information
  • Any applicable Restaurant conditions

An order is not necessarily accepted merely because it has been submitted.

The Restaurant may need to accept or confirm an order before it becomes final.

A paid online order is created only after Stripe confirms that the payment succeeded, as described in section 11.

Where an order cannot be fulfilled, the Restaurant or 3buddy may notify the Customer and, where appropriate, arrange a refund.

9 Food and product information

Restaurants are responsible for ensuring that information concerning their products is reasonably accurate.

This includes, where applicable:

  • Product descriptions
  • Ingredients
  • Allergens
  • Prices
  • Availability
  • Portion information
  • Dietary information

Customers with allergies or specific dietary requirements should contact the Restaurant directly before ordering where the information provided is insufficient.

3buddy does not independently verify every menu item, ingredient, allergen declaration or Restaurant claim.

10 Prices and taxes

Prices displayed through 3buddy are provided by the relevant Restaurant unless otherwise stated.

Restaurants are responsible for setting accurate prices and applicable taxes.

Prices may change before an order is submitted.

The total price presented at checkout is the price applicable to the order, subject to obvious errors and applicable law.

Online checkout amounts are charged in SEK.

Where a Restaurant is responsible for a transaction, the Restaurant is responsible for its tax, invoicing and accounting obligations.

11 Payments

This section explains how card payments work on 3buddy for Customers and Restaurants.

11.1 Payment provider

Online card payments on 3buddy are processed by Stripe, a third-party payment provider.

Depending on the service, available payment methods may include cards and other methods supported by Stripe.

3buddy does not store complete card numbers, CVV/security codes or other sensitive card authentication information. That information is handled by Stripe.

When a Customer pays online, the Customer is redirected to a secure Stripe Checkout page.

Payment processing is also subject to Stripe’s terms and privacy policy.

A payment may be declined, reversed, cancelled or subject to additional verification by Stripe.

11.2 Who the Customer pays

3buddy is a restaurant technology platform. It does not itself operate the Restaurant.

For online orders and online gift-card purchases, the payment is collected by Rexett AB through Stripe and then transferred to the Restaurant the Customer ordered from or bought the gift card from.

This means:

  • The charge is created on Rexett AB’s Stripe account.
  • The Restaurant receives the funds through its own Stripe Connect account.
  • The Restaurant name may appear on the order, receipt or gift card.
  • The name on Stripe Checkout or on the Customer’s bank or card statement may show Rexett AB, 3buddy, or a similar platform name.

That is normal for this payment model. It does not mean the Restaurant failed to receive the order.

11.3 How the money is split

When a Customer pays online:

  1. The Customer pays the full amount shown at checkout, in SEK.
  2. Stripe processes the card payment.
  3. Rexett AB / 3buddy retains a platform service fee.
  4. The remaining amount is transferred to the Restaurant’s Stripe account.
  5. The Restaurant later receives payouts from Stripe to its bank account, according to Stripe’s payout schedule and the Restaurant’s completed onboarding.

The current platform service fee is 10% of the online payment amount, unless Rexett AB and the Restaurant have agreed otherwise in writing.

Stripe also charges its own payment processing fees according to Stripe’s pricing. Those fees are separate from 3buddy’s platform fee.

The Restaurant remains responsible for the food, drink, pickup, delivery, gift-card value and customer service connected with the purchase.

11.4 What Customers should know

By placing an online order or paying for a gift card on 3buddy, the Customer agrees that:

  • The Customer will pay the amount displayed before confirming payment.
  • Payment is taken when Stripe Checkout is completed.
  • The paid order or gift card is created only after Stripe confirms that the payment succeeded.
  • Prices are shown in SEK and include applicable VAT unless otherwise stated.
  • Delivery fees, discounts, lunch cards, gift cards or other adjustments may change the amount charged.
  • If the Customer cancels before completing Stripe Checkout, no card payment is taken for that attempt.
  • Questions about the food, pickup time, delivery, allergens or a specific Restaurant should be directed to that Restaurant.
  • Questions about a card charge, a failed payment or a refund can be sent to the Restaurant and, where needed, to 3buddy.

If a payment fails, is declined or is not completed, the Restaurant is not obliged to prepare or deliver the order as a paid online order.

11.5 What Restaurants should know

To accept online card payments, the Restaurant must:

  • Connect a Stripe Express account through 3buddy.
  • Complete Stripe’s identity and onboarding checks.
  • Keep card payments and payouts enabled in Stripe.

3buddy cannot collect online card payments for a Restaurant until Stripe has enabled charges on that Restaurant’s connected account.

Once a Customer pays:

  • The Restaurant is responsible for fulfilling the order or honouring the gift card.
  • The Restaurant receives the payment minus the 3buddy platform fee and any amounts deducted by Stripe.
  • Payout timing, bank details and tax reporting for the Restaurant’s Stripe account are handled between the Restaurant and Stripe.
  • The Restaurant must keep its Stripe account information accurate and complete.

3buddy provides the software, checkout and payment routing. 3buddy does not prepare food, make deliveries or operate the Restaurant.

A Restaurant must not attempt to bypass the 3buddy checkout or platform fee in a way that breaches its agreement with Rexett AB.

11.6 What is paid online

Online orders

Card payment is required to place an online pickup or delivery order through 3buddy, unless another payment method is clearly offered.

Restaurant bookings

A table booking through 3buddy does not automatically include an online card payment, unless the Restaurant or the booking flow clearly says that a payment or prepayment is required.

Gift cards

If a gift card is paid online through 3buddy, the same Stripe payment flow applies. The Restaurant is responsible for the remaining balance and for how the card can be used.

Restaurant subscriptions

Restaurant subscription fees for 3buddy software are a separate commercial payment to Rexett AB and are described in sections 17 and 18.

11.7 Receipts and confirmations

After a successful payment, the Customer may receive:

  • A 3buddy order or gift-card confirmation
  • A Stripe payment receipt
  • Communication from the Restaurant

These confirmations should be kept. They are used if help is needed with an order, a payment or a refund.

11.8 Failed, delayed or incomplete payments

A payment may fail because the card is declined, Stripe Checkout is abandoned, Restaurant onboarding is incomplete, or a technical error occurs.

If Stripe does not confirm a successful payment:

  • No paid order should be treated as complete
  • The Restaurant should not fulfil the order as a paid online order
  • The Customer may try again

3buddy may wait for Stripe’s confirmation before creating or showing a paid order.

11.9 Fraud and security

We may refuse, delay or reverse a payment if we reasonably suspect fraud, misuse, unauthorised use of a card, or a breach of these Terms.

Customers must not use another person’s payment method without permission.

11.10 Stripe’s role

Stripe is an independent payment provider.

Stripe processes personal and payment data according to its own terms and privacy policy. For payment processing, Stripe may act as an independent controller or as a processor, depending on the service.

3buddy is not responsible for Stripe’s systems, payout delays caused by Stripe, or a bank’s handling of a card payment, except where required by law.

12 Refunds and cancelled orders

Refunds relating to food, beverages, bookings or other products purchased from a Restaurant are generally handled by the Restaurant responsible for the transaction.

The applicable refund and cancellation rules may depend on:

  • The type of purchase
  • Restaurant policy
  • The timing of cancellation
  • Applicable consumer law
  • Whether the Restaurant has accepted or started preparing the order

Where a card payment was taken through Stripe, an approved refund is processed through Stripe. It may take several business days to appear on the Customer’s card, depending on the bank.

Chargebacks and payment disputes are handled according to Stripe’s and the card network’s rules. If a Customer disputes a charge, the Restaurant must cooperate and provide the information needed to respond.

A refund is not automatic. A refund does not always include delivery fees, already prepared food, or amounts that the Restaurant is legally entitled to keep.

Nothing in these Terms removes or limits any mandatory consumer right.

For example, certain food products and services may be subject to statutory exceptions to the general right of withdrawal for distance purchases.

13 Right of withdrawal

Where Swedish or other applicable consumer legislation provides a statutory right of withdrawal, that right will apply regardless of anything inconsistent in these Terms.

For distance contracts, consumers may in general have a 14-day withdrawal period, although important statutory exceptions apply.

Examples of transactions that may be excluded from the general right of withdrawal include certain food purchases and services connected to a specific date or period.

Where applicable law requires a withdrawal function for an agreement entered into through a website or mobile application, the relevant withdrawal functionality will be provided in accordance with the law. Swedish rules introduced requirements for such a function from 19 June 2026.

Nothing in these Terms limits mandatory statutory consumer rights.

14 Restaurant bookings

3buddy may allow Customers to reserve tables at participating Restaurants.

A booking may be subject to:

  • Restaurant opening hours
  • Available tables
  • Party size
  • Restaurant booking rules
  • Maximum seating times
  • Special event conditions
  • Cancellation or no-show policies

The Restaurant is responsible for providing the reserved table and restaurant service.

3buddy is not responsible for the Restaurant’s failure to honour a reservation unless required by applicable law or expressly agreed otherwise.

Customers should contact the Restaurant directly if they need to modify or cancel a booking where the Platform does not provide that functionality.

15 Pickup orders

Where pickup ordering is available:

  • The Restaurant is responsible for preparing the order.
  • The Customer is responsible for collecting the order within the applicable collection period.
  • The Restaurant may establish reasonable pickup procedures.
  • Estimated preparation times are estimates and may change.

The Customer should follow the pickup instructions provided by the Restaurant.

16 Delivery

Where delivery is offered, the relevant Restaurant may be responsible for delivery.

Restaurants may define:

  • Delivery areas
  • Delivery fees
  • Minimum order values
  • Delivery times
  • Delivery conditions
  • Availability

3buddy does not guarantee delivery unless expressly stated otherwise.

The Restaurant remains responsible for fulfilling its delivery obligations where the Restaurant provides the delivery service.

17 Restaurant subscriptions and SaaS services

Restaurants may purchase subscription-based 3buddy services.

The applicable subscription price, billing period, included features and other commercial terms will be presented during signup or in the applicable Restaurant agreement.

Unless otherwise agreed:

  • Subscription fees are charged according to the selected billing period.
  • Prices may be subject to applicable VAT.
  • A Restaurant must maintain valid payment information where automatic billing is used.
  • Failure to pay may result in suspension or termination of the relevant service.

Business customers may have different contractual terms from consumers.

Where a separate written agreement exists between Rexett AB and a Restaurant, that agreement may supplement or supersede these Terms for the relevant commercial relationship.

18 Subscription cancellation

A Restaurant may cancel its subscription according to the applicable subscription terms or separate agreement.

Any applicable notice period, minimum term or renewal condition will be communicated before or when the subscription is entered into.

Cancellation does not normally remove amounts already due.

Where a Restaurant has an outstanding balance, Rexett AB may pursue payment of that balance in accordance with applicable law.

For consumer agreements, mandatory consumer cancellation rights apply where relevant.

19 Free trials and promotional offers

3buddy may occasionally offer:

  • Free trials
  • Discounted subscriptions
  • Promotional pricing
  • Limited-time features
  • Credits

Unless otherwise stated, promotional offers:

  • May be limited to one account or Restaurant.
  • May not be combined with other offers.
  • May have additional conditions.
  • May be withdrawn where permitted by law.

Any conditions presented with a promotion form part of the applicable offer.

20 Platform availability

3buddy aims to provide reliable and secure services but does not guarantee that the Platform will always be:

  • Available
  • Uninterrupted
  • Error-free
  • Free from delays
  • Compatible with every device
  • Available in every geographic location

The Platform may occasionally be unavailable due to:

  • Maintenance
  • Updates
  • Security measures
  • Infrastructure failures
  • Internet or telecommunications failures
  • Third-party service interruptions
  • Force majeure events
  • Other circumstances outside our reasonable control

Where reasonably possible, 3buddy will attempt to restore affected services.

21 Software updates and changes

3buddy may update the Platform to:

  • Improve security
  • Fix bugs
  • Improve performance
  • Add features
  • Remove obsolete functionality
  • Maintain compatibility
  • Comply with legal or regulatory requirements

Material changes affecting contractual rights will be handled in accordance with applicable law and any applicable contractual agreement.

22 Mobile applications

Where 3buddy provides a mobile application, the application may require access to device functionality such as:

  • Camera
  • Bluetooth
  • NFC
  • Local network
  • Notifications
  • Location, where required for an enabled feature
  • Other device functionality

The permissions required depend on the features being used.

The mobile application may communicate with Restaurant equipment or devices on the Restaurant’s local network where such functionality is supported.

Restaurants are responsible for ensuring that their local network, devices and equipment are appropriately configured and maintained.

23 Printers and local devices

3buddy may support Restaurant printers and other local hardware.

Local printing may depend on:

  • Compatible hardware
  • Local network connectivity
  • Bluetooth
  • Device permissions
  • Restaurant configuration
  • Printer availability
  • Operating-system functionality

3buddy does not guarantee compatibility with every printer or hardware configuration.

The Restaurant is responsible for maintaining its own hardware and local network unless a separate service agreement states otherwise.

24 Acceptable use

Users must use 3buddy lawfully and responsibly.

You must not:

  • Use 3buddy for unlawful purposes.
  • Attempt to gain unauthorised access to accounts or systems.
  • Circumvent authentication or security controls.

27 Reviews and user-generated content

Where 3buddy allows reviews, ratings, comments or other user-generated content, users must ensure that their content:

  • Is truthful to the best of their knowledge.
  • Does not contain unlawful threats or harassment.
  • Does not contain discriminatory or abusive content.
  • Does not infringe intellectual-property rights.
  • Does not disclose another person’s private information.
  • Is not fraudulent or deliberately misleading.

3buddy may remove content that violates these Terms or applicable law.

Where legally required, users may have rights concerning decisions to remove or restrict content.

28 Intellectual property

The Platform and its underlying technology are owned by or licensed to Rexett AB.

This includes, where applicable:

  • Software
  • Source code
  • Object code
  • Platform design
  • User interfaces
  • Logos
  • Trademarks
  • Graphics
  • Documentation
  • Database structures
  • Platform functionality

Except where expressly permitted, users may not copy, modify, distribute, sell, lease, sublicense or commercially exploit 3buddy’s intellectual property.

Restaurants retain ownership of content they independently provide to the Platform, subject to the licence described below.

29 Licence to Restaurant content

By uploading or providing content to 3buddy, a Restaurant grants Rexett AB a limited, non-exclusive licence to host, store, reproduce, display and technically process that content as necessary to provide the Services.

This may include:

  • Restaurant name
  • Logo
  • Menu items
  • Product photographs
  • Descriptions
  • Prices
  • Opening hours
  • Restaurant information

The licence continues for as long as reasonably necessary to provide the Services and to fulfil legal or contractual obligations.

Rexett AB does not acquire ownership of Restaurant content merely because it is uploaded to the Platform.

30 AI and automated functionality

3buddy may use artificial intelligence or automated technologies for certain features.

Examples may include:

  • AI-assisted ordering
  • Voice-based ordering
  • Automated classification
  • Recommendations
  • Search
  • Operational assistance
  • Content processing

AI-generated or automated results may contain errors.

Users and Restaurants should review important information before relying on it.

Where a feature involves personal data, processing is described in the 3buddy Privacy Policy and, where relevant, the applicable Restaurant privacy information.

3buddy does not guarantee that AI-generated information will always be accurate, complete or suitable for a particular purpose.

  • Payment providers
  • Cloud infrastructure providers
  • Authentication services
  • Analytics providers
  • Communication providers
  • AI providers

  • Other technology providers

Third-party services may have their own terms and privacy policies.

3buddy is not responsible for independent third-party services except to the extent required by applicable law or expressly agreed.

32 Privacy

Personal-data processing through 3buddy is governed by the separate:

3buddy Privacy Policy

The Privacy Policy explains how personal data is collected, used, stored, shared and protected.

The Privacy Policy forms part of the overall legal framework governing use of the Platform but does not replace these Terms.

33 Cookies

Cookies and similar technologies are governed by the separate:

3buddy Cookie Policy

The Cookie Policy explains which cookies and similar technologies may be used and how applicable consent can be managed.

34 Data protection responsibilities of Restaurants

Depending on the service and processing activity, a Restaurant may act as a data controller and Rexett AB may act as a data processor.

Where required, the parties may enter into a separate Data Processing Agreement (“DPA”).

The DPA governs processing performed by Rexett AB on behalf of the Restaurant where applicable.

Restaurants remain responsible for determining their own lawful purposes and legal bases for personal-data processing where they act as controller.

35 Security

3buddy implements reasonable technical and organisational measures intended to protect the Platform and information processed through it.

However, no internet service can be guaranteed to be completely secure.

Users must also take reasonable security measures, including:

  • Protecting passwords
  • Using secure devices
  • Restricting account access
  • Keeping supported software updated
  • Reporting suspected security incidents

36 Account suspension and termination

Rexett AB may suspend or terminate access where reasonably necessary, including where:

  • These Terms are materially violated.
  • The account is used unlawfully.
  • Fraud or abuse is suspected.
  • Payment obligations are not met.
  • Continued access creates a security risk.
  • The account threatens the operation or security of the Platform.
  • Required by law.

Where appropriate and legally permitted, 3buddy may provide notice and an opportunity to resolve the issue before suspension or termination.

Termination does not remove obligations that arose before termination.

37 Effect of termination

After termination:

  • Access to the affected Services may cease.
  • Outstanding fees may remain payable.
  • Restaurant content may be removed in accordance with applicable agreements and retention requirements.
  • Certain information may be retained where required by law or legitimate legal, accounting or security purposes.

Personal-data retention is governed by the Privacy Policy and applicable law.

38 Disclaimer

To the extent permitted by law, 3buddy provides the Platform based on the functionality available at the relevant time.

We do not guarantee that:

  • Restaurant information is always accurate.
  • Restaurant products will always be available.
  • Orders will always be accepted.
  • Restaurants will always fulfil bookings.
  • Third-party services will always be available.
  • The Platform will always operate without interruption.

Nothing in these Terms excludes statutory rights that cannot legally be excluded.

39 Limitation of liability

To the maximum extent permitted by applicable law, Rexett AB is not responsible for indirect or consequential losses arising from use of the Platform.

This may include, where legally permitted:

  • Loss of profit
  • Loss of revenue
  • Loss of business opportunity
  • Loss caused by Restaurant decisions
  • Loss caused by third-party services
  • Loss caused by internet or telecommunications failures

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability that cannot legally be excluded.

For Restaurant customers under a separate commercial agreement, any agreed liability limitations in that agreement may apply.

40 Restaurant transactions

Where a Customer purchases food, beverages or other products from a Restaurant:

  • The Restaurant is responsible for the products.
  • The Restaurant is responsible for fulfilling the order.
  • The Restaurant is responsible for applicable food and consumer requirements.
  • The Restaurant is generally responsible for refunds relating to its products.
  • The Restaurant is responsible for its own pricing and tax obligations.

3buddy provides the technical platform used to facilitate the transaction unless the applicable service explicitly states otherwise.

Card payments for those transactions are collected and routed as described in section 11.

41 Future marketplace services

3buddy may in the future operate additional marketplace functionality allowing Customers to discover Restaurants based on factors such as location, availability, cuisine, opening hours or other criteria.

If marketplace services are introduced, additional terms may apply.

These may cover:

  • Restaurant onboarding
  • Commission
  • Payments
  • Restaurant payouts
  • Delivery
  • Refunds
  • Customer support
  • Marketplace ranking and visibility
  • Promotions
  • Restaurant responsibilities

The applicable marketplace terms will be presented before the relevant service is used.

42 Geographic availability

3buddy is operated from Sweden and may initially be designed primarily for the Swedish market.

Certain features may not be available in all countries.

Restaurants and Customers are responsible for complying with applicable local laws when using the Platform.

Rexett AB is not responsible for delays or failures caused by circumstances beyond its reasonable control.

Such circumstances may include:

  • Major infrastructure failures
  • Cybersecurity incidents beyond reasonable preventative measures

  • Improve clarity.
  • Address legal or regulatory changes.
  • Improve security.
  • Change business or technical arrangements.

The updated version will be published through the relevant 3buddy website or application.

Where applicable law requires advance notice or consent, Rexett AB will provide such notice or obtain such consent.

The “Last updated” date at the beginning of these Terms indicates when the Terms were most recently updated.

45 Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision should, where legally possible, be interpreted or replaced in a way that most closely achieves its original lawful purpose.

46 No waiver

Failure by Rexett AB to enforce a provision of these Terms does not constitute a waiver of the right to enforce that provision later.

47 Entire agreement

These Terms, together with any applicable:

  • Subscription agreement
  • Restaurant agreement
  • Data Processing Agreement
  • Privacy Policy
  • Cookie Policy
  • Order-specific conditions
  • Promotional conditions

form the applicable contractual framework for the relevant 3buddy service.

Where documents conflict, mandatory law takes precedence.

For a specific commercial agreement with a Restaurant, the individually agreed commercial terms may take precedence over these general Terms where expressly stated.

48 Applicable law

These Terms are governed by the laws of Sweden, unless mandatory consumer-protection legislation requires otherwise.

Nothing in this section removes any mandatory rights a consumer may have under applicable law.

49 Disputes

We encourage users and Restaurants to contact 3buddy first so that disputes can be resolved directly.

For consumer disputes, applicable Swedish consumer dispute mechanisms may be available.

A consumer may, where applicable, have the right to bring a dispute before the appropriate Swedish court or other competent dispute-resolution body.

Nothing in these Terms prevents a consumer from exercising mandatory statutory rights.
